These Booking Terms & Conditions (“Terms”) apply to all retreat bookings made with Naqaha (“Naqaha”, “we”, “us”, “our”).
By submitting a booking, making any payment toward a retreat, or selecting the acceptance checkbox during checkout, you (“Guest”, “you”, “your”) confirm that you have read, understood and agreed to these Terms.
If you make a booking that includes another guest, you confirm that you are authorized to provide that guest's information for the purposes of the booking and that the other guest has been informed of the terms applicable to their participation.
These Terms should be read together with the information displayed on the applicable retreat page, including the retreat dates, price, inclusions and exclusions.

Eligibility
Unless expressly stated otherwise for a particular retreat, guests must be at least 18 years old on the retreat start date.
Guests are responsible for ensuring that they satisfy any passport, visa, immigration, health, fitness or other requirements applicable to their participation.
Naqaha may establish additional reasonable eligibility or participation requirements for a particular retreat where necessary due to the destination, accommodation, activities or safety considerations.

Booking and Confirmation
Submitting booking information does not by itself create a confirmed reservation.
A booking is confirmed only when the required payment has been successfully received and verified by Naqaha and Naqaha issues a booking confirmation.
Guests are responsible for checking their booking confirmation and promptly notifying Naqaha of any incorrect information.
The booking reference provided in the confirmation should be retained and quoted in correspondence concerning the booking.

Retreat Prices
The price applicable to your booking is the price displayed during checkout at the time the booking is made.
The retreat page will identify what is included and excluded from the applicable retreat.
Unless expressly stated otherwise, retreat prices do not include flights, visas, travel insurance, personal expenses, optional activities, additional accommodation, transportation not specifically listed as included, or other expenses incurred by the Guest.
Naqaha is not responsible for increases in costs independently incurred by Guests after making a booking.

Payment Options
Where available, Naqaha may offer Guests the choice of:
Deposit — payment of 30% of the total retreat price per person at the time of booking, with the remaining balance payable by the applicable Payment Due Date.
Pay in Full — payment of 100% of the total retreat price at the time of booking.
Regardless of the payment option selected, 30% of the total retreat price per person constitutes the non-refundable booking portion once the booking has been confirmed.
For the avoidance of doubt, where a Guest chooses to Pay in Full, 30% of the total retreat price remains non-refundable and any refund of the remaining amount will be determined in accordance with Section 7 below.

Remaining Balance
Where a Guest selects the Deposit option, the outstanding balance must be paid by the Payment Due Date stated for the applicable retreat or otherwise communicated by Naqaha.
Naqaha may send payment reminders as a courtesy; however, responsibility for paying the balance on time remains with the Guest.
If the balance is not received by the applicable Payment Due Date, Naqaha may cancel the booking after providing reasonable notice.
In such circumstances, amounts already paid will be treated in accordance with the cancellation provisions in these Terms.

Payment Processing
Payments are processed through Naqaha's authorized third-party payment service provider.
A payment is not considered successfully received merely because a Guest has submitted payment information. Payment must be successfully authorized and verified.
Where a refund is due, Naqaha will ordinarily issue it to the original payment method where reasonably possible.
Banks, card issuers and payment providers may require additional time to process and display refunds after Naqaha has initiated them. Naqaha does not control those external processing times.

Guest Cancellations
All cancellation requests must be made in writing to Naqaha at the contact address specified in Section 23.
The effective cancellation date will be the date on which Naqaha receives the written cancellation request.
Due to Naqaha's advance commitments to accommodation providers, instructors, venues, activity providers and other suppliers, cancellation charges apply as follows.
7.1 Cancellation 90 Days or More Before the Retreat Start Date
If you cancel 90 days or more before the retreat Start Date:
You will be refunded the amounts paid toward your booking excluding 30% of the total retreat price per person, which is non-refundable.
For example, where a Guest has paid the retreat price in full, Naqaha will retain the 30% non-refundable portion and refund the remaining 70%, subject to these Terms.
7.2 Cancellation Between 60 and 89 Days Before the Retreat Start Date
If you cancel between 60 and 89 days before the retreat Start Date:
Naqaha will refund 50% of the refundable portion of the amounts paid, after excluding the non-refundable 30% portion of the total retreat price.
7.3 Cancellation Fewer Than 60 Days Before the Retreat Start Date
If you cancel fewer than 60 days before the retreat Start Date, all amounts paid are non-refundable.
7.4 Non-Refundable Portion
The 30% non-refundable portion applies regardless of whether the Guest originally selected:
• Deposit; or
• Pay in Full.
Selecting Pay in Full does not make the 30% booking portion refundable.
7.5 Late Arrival, Early Departure and Non-Attendance
No refund, credit or price reduction will ordinarily be provided where a Guest:
• fails to attend the retreat;
• arrives after the retreat has begun;
• leaves before the retreat has concluded; or
• voluntarily chooses not to participate in included activities.
Nothing in this Section limits any mandatory refund or cancellation right available to a Guest under applicable law.

Cancellation or Material Change by Naqaha
Naqaha reserves the right to cancel, postpone or materially change a retreat where reasonably necessary, including because of safety concerns, insufficient operational feasibility, venue or supplier issues, government restrictions, natural events or circumstances outside Naqaha's reasonable control.
Where Naqaha cancels the entire retreat before it begins, affected Guests will be offered, subject to applicable law, either:
Retreat Credit: transfer eligible amounts paid to another available Naqaha retreat or retain them as credit for a future Naqaha retreat within the validity period communicated by Naqaha;
or
Refund: request a refund of eligible amounts paid directly to Naqaha.
Naqaha is not responsible for independently booked flights, hotels, visas, transportation, loss of earnings or other third-party expenses incurred in connection with a cancelled or changed retreat, except where such liability cannot lawfully be excluded.

Changes to the Retreat Program
Retreat itineraries are provided in good faith but may occasionally require adjustment.
Naqaha may reasonably modify the sequence, timing, instructor, venue, accommodation arrangement or activity where necessary because of weather, safety, illness, supplier availability, local conditions or other circumstances.
Where a significant advertised element becomes unavailable, Naqaha will use reasonable efforts to provide a suitable alternative.
Minor or reasonable program changes do not constitute cancellation of the retreat and do not automatically entitle a Guest to a refund.
The reference terms similarly contemplate program or team changes where circumstances make the original arrangement unavailable.

Flights, Passports, Visas and Travel Arrangements
Unless expressly identified as included in the retreat, Guests are responsible for arranging and paying for their own:
• flights;
• passports;
• visas and entry permits;
• required travel documentation;
• transportation to the designated arrival or meeting point;
• additional accommodation; and
• other personal travel arrangements.
Guests are responsible for verifying entry and transit requirements applicable to their nationality and itinerary.
Naqaha is not responsible for a Guest being unable to attend because of missing, invalid or insufficient travel documentation.
Guests should avoid making non-refundable independent travel arrangements until they are satisfied that their retreat arrangements are sufficiently confirmed.

Travel Insurance
Guests are required to obtain appropriate travel insurance for their retreat unless Naqaha expressly states otherwise.
The policy should provide appropriate coverage for the Guest's destination and planned activities and should ordinarily include, where applicable:
• medical treatment;
• emergency medical assistance and evacuation;
• trip cancellation or interruption;
• illness and injury;
• travel delay or disruption;
• lost or delayed baggage; and
• activities undertaken during the retreat.
Guests are responsible for reviewing their policy's coverage, limits and exclusions.
Naqaha does not provide insurance advice and is not responsible for losses that would otherwise have been recoverable under suitable insurance.
The reference terms similarly make obtaining adequate travel insurance the guest's responsibility and require coverage appropriate to retreat activities.

Health and Fitness
Naqaha retreats may include physical and wellness activities including, depending on the retreat, Pilates, yoga, hiking, swimming, breathwork, meditation, fitness sessions and other activities.
Guests are responsible for determining whether they are physically and medically capable of participating.
If you have an injury, medical condition, pregnancy, allergy, dietary requirement or other circumstance that could materially affect your safe participation, you should obtain appropriate professional advice before participating and provide Naqaha with information reasonably requested for your safety or the proper delivery of the retreat.
Naqaha does not provide medical advice.
If you experience significant pain, illness, dizziness or discomfort during an activity, you should stop participating and notify the relevant instructor or Naqaha representative.
The source terms similarly place responsibility on guests to assess their health and seek appropriate medical clearance.

Acknowledgement of Risk
You acknowledge that travel, exercise, wellness activities and outdoor activities may involve inherent risks.
Participation in individual activities is voluntary.
Guests agree to follow reasonable instructions given by Naqaha, instructors, guides, venues and activity providers concerning safety and participation.
Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

Third-Party Providers
Naqaha may use independent accommodation providers, instructors, guides, transportation providers, restaurants, wellness professionals, activity operators and other third parties in delivering a retreat.
Guests may be required to comply with reasonable rules, safety procedures and operating conditions imposed by those providers.
Naqaha will exercise reasonable care when selecting and coordinating providers but cannot guarantee that a third-party service will never be modified, delayed or unavailable due to circumstances outside Naqaha's reasonable control.

Guest Conduct
Guests are expected to behave respectfully toward other Guests, Naqaha representatives, instructors, suppliers, accommodation staff and local communities.
Naqaha may take reasonable action where a Guest:
• threatens the health or safety of another person;
• engages in harassment, abusive or seriously disruptive behavior;
• intentionally damages property;
• violates applicable law;
• repeatedly refuses reasonable safety instructions; or
• materially interferes with other Guests' enjoyment of the retreat.
In serious circumstances, Naqaha may require a Guest to leave the retreat.
Any entitlement to a refund in those circumstances will be determined in accordance with these Terms and applicable law.

Personal Property
Guests remain responsible for their own passports, money, luggage, electronics, jewelry and other personal property.
Guests should take reasonable precautions to secure valuables and ensure that appropriate travel insurance covers personal belongings.

Photography and Video
Naqaha may photograph or record portions of a retreat for brand, editorial, social-media or promotional purposes.
Where appropriate or required, Guests will be given an opportunity to provide or decline consent to identifiable commercial use of their image.
Naqaha may establish separate photography/video consent procedures for individual retreats.

Force Majeure and Circumstances Outside Our Control
Naqaha will not be responsible for failure or delay in performing obligations where performance is prevented or materially affected by circumstances outside its reasonable control, subject to applicable law.
These circumstances may include severe weather, natural disasters, public-health emergencies, governmental restrictions, civil disturbance, transportation disruption, venue closure or comparable events.
Naqaha will use reasonable efforts to communicate material developments and identify appropriate alternatives where practicable.

Limitation of Liability
To the maximum extent permitted by applicable law, Naqaha will not be liable for indirect or consequential losses arising from a retreat booking or participation.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including any mandatory consumer rights.

Privacy and Personal Information
Naqaha processes personal information provided in connection with retreat enquiries and bookings in accordance with its Privacy Policy and applicable data-protection requirements.
Naqaha may provide relevant information to accommodation providers, instructors, transportation providers or other service providers where reasonably necessary to administer the Guest's retreat.
Payment-card information is processed by Naqaha's payment service provider.

Governing Law and Jurisdiction
These Terms and any dispute arising from or relating to them shall be governed by the applicable laws and regulations of the Kingdom of Saudi Arabia, subject to any mandatory consumer rights or other laws that may apply.
The courts or competent authorities having jurisdiction shall be determined in accordance with applicable law.

Acceptance of Terms
By completing a booking and accepting these Terms during checkout, you confirm that you have read and understood these Booking Terms & Conditions and agree to be bound by them.
Where you book on behalf of another Guest, you are responsible for ensuring that they are made aware of the terms relevant to their participation.
